Terms and conditions

1. Purpose

These terms govern access to and use of Emargix, a digital attendance platform for creating events, collecting electronic signatures and exporting attendance sheets. Using the service means you fully accept these terms.

The service is published by Stéphane Badiane, sole proprietor (see the legal notice, in French).

2. User account

Creating an account requires a valid email address. Each user is responsible for keeping their login details confidential and for the activity carried out from their account. One mailbox opens one workspace: variants of an address (for example with “+” or, for Gmail, with dots) count as the same address. To work as a team, the workspace owner invites the other members.

3. Plans and billing

Emargix offers a Free plan and paid plans (Pro, Structure). Their details, quotas and prices, shown in the currency of the user's country, are published and kept up to date on the pricing page. Paid plans are billed monthly. The quota counts each participant once per calendar month, however many sessions they sign. On paid plans, any participants beyond the included quota are charged at the rate shown on that same page, as in force when the month closes, and added to the next plan payment. The plan that applies to a month is the one in force at the last signature of that month. On the Free plan, signatures beyond the quota are kept but hidden.

Compliance options are paid with prepaid credits: one credit per signed-in participant per event. Turning on an option requires a positive credit balance or a billing contract with Emargix. A balance that turns negative during a workshop does not stop sign-in; the evidence pack then stays unavailable until the balance is topped up, unless a billing contract with Emargix applies.

Payments in CFA francs are collected by GeniusPay. Outside the CFA franc zone, purchases are sold by our reseller Paddle.com Market Limited, which is the merchant of record for those orders: it collects the payment, issues the receipt, applies any tax and handles refunds, under its own buyer terms.

4. Cancellation

Every user can close their account or return to the Free plan at any time. Cancellation takes effect at the end of the current billing period; the period already started is not refunded pro rata. Refund conditions for purchases are set out in the refund policy.

5. Data and content

Events, participants and signatures created by a user belong to them. Emargix does not use them for any purpose other than providing the service. Hosting and data retention are detailed in the privacy policy.

6. Liability

Emargix takes reasonable measures to keep the service available and secure, without guaranteeing uninterrupted availability. Emargix is not liable for downtime caused by force majeure or by a third party (hosting provider, internet access provider).
